1. This is an application for relaxation of conditions of bail. Bail was granted to the petitioner on July 31, 2023, inter alia, on the condition that he shall furnish a bond of Rs.20,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, South 24 Parganas at Alipore.

2. The petitioner says that he is impecunious. He is not in a position to furnish bail bond of Rs.20,000/-. He further says that he is unable to find a local surety. He prays that the bail bond amount be reduced to Rs.2,000/- and he be allowed to furnish two registered sureties.

3. We have considered the facts and circumstances of the case and we have heard learned Counsel for the State. Bail was granted to the petitioner about one year and five months ago. He has not been able to reap benefit of such order. Taking a lenient approach, we allow the prayer of the petitioner.

4. The order dated July 31, 2023, passed in CRM (DB) 3020 of 2023, is modified to the extent that the petitioner shall be released on bail upon furnishing a bond of Rs.2,000/-, with two registered sureties, to the satisfaction of the learned Chief Judicial Magistrate, South 24 Parganas at Alipore.

5. The other conditions of bail remain unaltered.

6. CRAN 1 of 2024 stands disposed of.

7. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
