17.12.2021 sdas rejected C.R.M. 7824 of 2021 (via video conferencing) In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Bhagwangola Police Station Case No. 92 of 2021 dated 21.02.2021 under Sections 304/34 of the Indian Penal Code.

And In Re : Pakhi Sk. ..... petitioner Mr. Kallol Mondal ... for the petitioner Mr. Neguive Ahmed, learned APP ... for the State It is submitted by the learned Counsel appearing for the petitioner that he has been falsely implicated in the instant case. Incident occurred in the course of a sudden quarrel and cause of death is due to smothering.

Learned Counsel appearing for the State opposes prayer for anticipatory bail.

Statements of witnesses disclose that the petitioner indiscriminately assaulted the deceased and as a result of the victim suffered injuries and was smothered to death. In view of the aforesaid facts prima facie disclosing involvement of the petitioner in the alleged crime, we are not inclined to grant anticipatory bail to him.

Accordingly, prayer for anticipatory bail is rejected. (Bivas Pattanayak, J.) (Joymalya Bagchi, J.)
