Mr. Surojit Basu Mr. Rudraksha Chakraborty ... for the petitioners. Mr. Debasish Roy Mr. Suman De Mr. Debangshu Ghorai ... for the State. This is an application wherein petitioners have challenged the order dated 24th June, 2025 by which warrant of arrest has been issued against the petitioners.

It is submitted on behalf of the petitioners that a case has been initiated against one co-accused under section 363/366/34 of the IPC and that co-accused has already married the victim defacto complainant and they are now blessed with a child. The petitioners earlier obtained regular bail from the learned court below.

Due to lack of communication with the learned counsel appearing for the petitioners, they could not attend court on 24th June, 2025, when the warrant of arrest was issued. Now the petitioners intend to surrender before the court below.

Mr. De, learned counsel, who usually appears before the court on behalf of the State is hereby appointed to represent the State. Concerned authority is directed to regularize the appointment of Mr. De.

Having heard learned counsel appearing on behalf of the petitioners and the State, the instant application being CRR 3416 of 2025 is hereby disposed of giving liberty to the

petitioners to surrender before the court below within a period of two weeks from this date and in the event of such surrender by the petitioners, the court below will dispose of their prayers in accordance with law without being influenced by any observation made hereinabove.

The impugned order dated 24.06.2025 by which warrant of arrest was issued against the petitioners is stayed for a period of two weeks or till the petitioners surrender before the trial court, whichever is earlier.
