Mr. Ranajit Chatterjee Mr. Aniruddha Mitra ...for the petitioners The writ petition is taken up for hearing when Mr. Ranajit Chatterjee, learned advocate appears for the petitioners and submits that there are two partners who have preferred this writ petition being writ petitioner nos. 2 & 3 and the first writ petitioner is M/s Tiwari Iron & Steel Company which is being represented by writ petitioner nos. 2 & 3. It is further been submitted by Mr. Chatterjee, learned advocate that during pendency of this writ petition one of the partners namely Mukteshwar Tiwari has died and another partner being the writ petitioner no. 2 viz. Smt. Monorama Tiwari has written a letter dated 10th January, 2021 by which said Smt. Monorama Tiwari has requested her advocate not to proceed with the matter. The said letter of the writ petitioner no. 3 is taken on record.

In spite of service of notice upon the respondent Bank no one is representing Union Bank

of India today. The notice dated 3rd February, 2022 is also taken on record.

In view of submission being made on behalf of the writ petitioner the present writ petition stands dismissed on the ground of non-prosecution.

Interim order, if any, stands vacated.

Urgent photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
