APP Mr. Manoranjan Mahata ..........for the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioners in connection with Andal P.S. Case No. 128 of 2021 dated 11.05.2021 under Sections 392/397/411 of the Indian Penal Code and under Sections 25(1B)(a)/35 of the Arms Act, 1959. Mr. Ghosh, learned advocate appearing for the petitioners submits that the petitioners had been arrested on 17th May, 2021. They had been roped in on the basis of vague allegations. In the said conspectus, the petitioners may be enlarged on bail on any stringent condition.

Mr. Sur, learned Additional Public Prosecutor appearing for the State opposes the petitioners' prayer and draws our attention to the statements of the witnesses and other materials in the case diary. He further submits that the petitioners have been identified in the Test Identification Parade and there are strong incriminating materials on record against them.

Having heard the learned advocates appearing for the respective parties and considering the materials in the case diary, the seriousness of the offence and the extent of complicity of the petitioners in the alleged offence, we are not inclined to exercise any discretion in their favour. As such, their prayer for bail is rejected at this stage.

The application CRM 7829 of 2021 is, accordingly, dismissed.
