Re: CAN 1 of 2023 This is an application for restoration of the connected writ petition which was dismissed for default on September 19, 2023.

Perused the application, it appears that the petitioner was prevented by sufficient cause from appearing before the Court when the matter was called on for hearing, the order dated September 19, 2023 is, therefore, recalled.

W.P.A. 17887 of 2023 is restored to its original file and number.

I.A. No. CAN 1 of 2023 is, thus, allowed without any order as to costs.

The petitioner participated in the 1st State Level Selection Test, 2016 for recruitment of Assistant Teachers for classes IX & X and was successful, in pursuance thereof, she was given appointment at Ghoshpur Akshoy High School (HS), Sandeshkhali, Basirhat, District- 24Parganas (North).

The petitioner is praying general transfer on the grounds of her illness and that the distance between her residence and the school is more than 82 kilometres.

The grounds are not convincing to allow the prayer of the petitioner for general transfer, particularly when she has joined the school only in the year 2019.

W.P.A. 17887 of 2023 is disposed of with the above terms without any order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
