...for the State The petitioner is aggrieved that notwithstanding the complaint to the Kolkata Leather Complex Police Station, South 24-Parganas, there is no action taken. The petitioner has also taken a proceeding under Section 144 of the Code of Criminal Procedure and has addressed the complaint to the Chief Technical Officer, Salt Lake and the Block Land & Land Reforms Officer, Bhangar-II.

This Court is of the view that this dispute is purely civil in nature between the family members in respect of a joint family property in which parts and portions are claimed against one another. Admittedly, TS No. 3481 of 2018 is pending before the learned 7th Court of the Civil Judge (Senior Division) at Alipore. Parties shall trash out their differences in the pending suit before any other civil forum and may approach in accordance with law.

With the above observations, WPA 18961 of 2021 and CAN 1 of 2022 are disposed of.
