Petitioner has already preferred an application under Section 126(2) of the Code of Criminal Procedure for setting aside order dated 7.01.2023 which is pending before the learned Judicial Magistrate, 3rd court, Alipore in connection with ACM-671 of 2020. Such application was filed on 04.01.2023 and date was fixed on 11th April, 2023, but till date the same has not been disposed of.

In view of the submission made by the learned advocate for the petitioner, I direct that the said application be disposed of by 18th October, 2023. No unnecessary adjournments should be granted to either of the parties. .

With the aforesaid observations, the revisional application being CRR 2763 of 2023 is disposed of.
