Affidavit-of-service filed on behalf of the petitioner is taken on record.

Petitioner participated in 1st State Level Selection Test, 2016 (Upper Primary) (Work Education and Physical Education) but he was not called for personality test. On being aggrieved petitioner filed the present writ petition praying for certain directions upon the respondent authorities which would permit the petitioner to be considered afresh in connection with aforesaid selection process.

Learned advocate representing the West Bengal Central School Service Commission has submitted that in response to RTI application of the petitioner, petitioner was informed that he was awarded 73 marks whereas cut off marks fixed for participating in

personality test under the category of the petitioner in connection with the aforesaid selection process was 77.

It is also submitted that panel in connection with the aforesaid selection process was prepared on 12th December, 2018 and same expired on 11th December, 2019.

Having considered the respective submissions made on behalf of the parities it appears that taking note of the marks awarded to the petitioner in the aforesaid selection process petitioner did not come within the zone of consideration for participating in personality test. Petitioner was awarded 73 marks whereas 77 was fixed as cut off marks under the category of the petitioner.

However it needs to be recorded that calculation of marks which was awarded in favour of the petitioner is disputed by the learned advocate representing the petitioner. In connection with the aforesaid selection process panel was prepared on 12th December, 2018 and same expired on 11th December, 2019.

It is trite that after expiry of the panel right of the candidate to question selection process is withered away. In this regard reliance is placed on the

judgments of the Hon'ble Supreme Court, one reported in (1996) 9 SCC 309 (State of Uttar Pradesh & Ors. vs. Harish Chandra & Ors.) and another reported in (2009) 2 SCC 706 (Girdhar Kumar Dadhich & Anr. vs. State of Rajasthan & Ors.).

Hence, writ petition stands dismissed.
