Bhattacharyya, learned Senior Standing Counsel, who usually represents the State is present in Court and is requested to appear in this matter. Let the appointment of Mr. Bhattacharyya along with a junior of his choice be regularised by the concerned authority.

A copy of the writ petition has been served upon Mr. Bhattacharyya in course of hearing of this writ petition. The petitioner has claimed interest on the compensation amount for the period from April 11, 2023 to May 31, 2025. It appears from the order dated February 6, 2023, passed by the learned Additional District Judge, 1st Court, Asansol, Paschim Bardhaman in L.A. Case No.10 of 2022 that the concerned L.A. Collector referred the compensation award along with papers and cheque bearing no.609620 dated November 22, 2021 amounting to Rs.24,69,190/- to the Learned District Judge, Paschim Bardhaman for hearing and payment of the awarded money upon determination as to which of the claimant shall be entitled to get the compensation money.

It appears that there was a dispute between the petitioner Raj Kumar Ruhidas and one Binod Kumar Burnwal with regard to the entitlement of compensation amount. The learned L.A. Judge by an order dated February 6, 2023 allowed the L.A. case on consent and permitted the petitioner to withdraw the awarded compensation money.

It further appears from the record that the Special Land Acquisition Officer, Paschim Bardhaman by a memo dated April 11, 2023 informed the petitioner that the awarded amount has already been deposited in the Court of the Learned District Judge, Paschim Bardhaman by the competent authority and the petitioner was requested to take measure to withdraw the compensation amount. Thus, there was no inaction on the part of the State in depositing the compensation amount and for such reason this Court is of the considered view that the State should not be saddled with a direction for payment of any interest on the compensation amount.

With the above observation, the writ petition stands disposed of.

There will be no order as to costs.
