1. Heard the submissions made by the learned counsels for the parties.

2. Perused the materials in the Case Diary and the content of F.I.R.

3. It is submitted on behalf of the petitioner that the present petitioner also lodged a complaint against one Prem Kumar Ray who is the principal accused and he was arrested on the basis of the said complaint of the present petitioner and while rejecting the prayer for his regular bail the learned trial court expressed that three other criminal cases are pending against him. It is further submitted that he is a habitual offender and he induced the name of the present petitioner being proprietor of the concern and used his account in order to defraud the de facto complainant.

4. On perusal of the materials of Case Diary, the nature of complaint made and the statements of various witnesses recorded under section 180 BNSS and considering that the present petitioner is a permanent resident of the State of Bihar, this Court is of the view that it is not a fit case to extend the benefit of section 482 of B.N.S.S. to the present petitioner.

5. Accordingly, prayer for anticipatory bail stands rejected.

6. Case Diary is, however, returned.
