Mr. Bandopadhyay, Counsel for the alleged contemnor produced the order-sheet of the SubDivisional Officer, Diamond Harbour, South 24 Parganas culminating in the order dated 29th March, 2022.

The encroachment by the private respondent is found to be illegal and unauthorized. The Assistant Engineer, P.W.D, has been asked to remove such encroachment and unauthorized construction.

It is expected that the Assistant Engineer, P.W.D. shall take immediate and urgent steps to comply with the finding of the Sub-Divisional Officer, Diamond Harbour, South 24 Parganas subject to, however, any provisions of the West Bengal Highways Act, 1964.

The communication dated 28th July, 2021 and the orders of the S.D.O., Diamond Harbour, South 24 Parganas are kept with the record.

In that view of the matter, the contempt application shall stand disposed of.

Rule, if any, shall also stand discharged.

There will be no order as to costs.

All parties are directed to act on a server copy of this order on usual undertakings.
