Learned advocate for the petitioner is aggrieved by the order dated 24th March, 2023 passed by the learned Additional Sessions Judge, Fast Track, 1st Court, Lalbag, Murshidabad in respect of Sessions Serial No. 236 of 2003 arising out of Raninagar P. S. Case No. 11 of 2002 dated 12th March,2002. The learned Sessions Court while passing the order categorically observed that the other case being G. R Case No.144 of 2002 was not committed to the said court. The present case being Sessions Serial No. 236 of 2003( G. R. Case No. 143 of 2002) has already reached the stage of argument. Petitioner is directed to serve a copy of the revisional application upon Ms. Baisali Basu, learned advocate who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned Authorities in due course. Learned advocate for the petitioner has also drawn the attention of this court to the order dated 26.07.2019 where there

was a direction passed by the learned Additional Sessions Judge for expeditious committal of the record of G. R. Case No. 144 of 2002. Dates were subsequently fixed by the learned Sessions Court. However, the stage of both the cases have reached at different stages. Consequently, I am not inclined to interfere at this belated stage in respect of the order dated 24.03.2023 passed by the learned Additional Sessions Judge, Fast Track, 1st court, Lalbag, Murshidabad.

Petitioner is directed to proceed with the arguments of the case as directed by the learned trial court.

With the aforesaid observations, the present revisional application being CRR 2765 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. Urgent Photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities. [Tirthankar Ghosh, J]
