Mr. Moyukh Mukherjee ... for the petitioner The petitioner preferred this revisional application for setting aside the order dated 31.08.2018 by which bail granted to the petitioner was cancelled in terms of Section 439(2) of the Code of Criminal Procedure with the direction upon the petitioner to surrender within a period of 7 days from the date of order passed in connection with G.R Case No.567 of 2016 arising out of Rangli Rangliot Police Station case No.62 of 2016 dated 15.12.2016 under Sections 406/409 of the Indian Penal Code now pending in the Court of Special Judge-cum-Additional District Judge, Court-1, Darjeeling, inter alia, on the grounds stated in the application.
Now it is submitted that in terms of that order the petitioner had surrendered before the Court and was released on bail. Accordingly, Mr. Moyukh Mukherjee, learned advocate for the
petitioner submits that the petitioner is not interested to proceed with the case. The revisional application being CRR 2568 of 2018 be disposed of for non-prosecution. All other applications pending for extension of interim order earlier granted in this case stands disposed of accordingly.
