Mr. Shibasish Banerjee Mr. Sanatan Panja ... for the State-Respondent(s) Mr. Sengupta, learned advocate, appearing on behalf of the State submits list of cases where it has been reflected that 11 cases are pending within the jurisdiction of Kolkata and nine cases are pending within the jurisdiction of Bidhannagar Police Commissionerate.

Be that as it may, as the genesis of the case was in respect of the petitioner being in the management of a particular company, I am of the opinion that if there are issues associated with

the company and the prescribed punishment is not more than seven years, in that case, the police authorities would preferably issue notices under Section 41A of the Cr.P.C. and/or Section 35(3) of the BNSS.

So far as the other cases are concerned, the police authorities would adhere to the statutory provisions and take steps in accordance with law.

With the aforesaid observations, WPA 17756 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
