The petitioner is in custody for about a year and prays for bail. He seeks parity with the co-accused who have been granted bail earlier.

Learned counsel for the State opposes the prayer. It appears that the co-accused have been granted bail considering their period of detention for four years. The petitioner cannot be said to be similarly circumstanced with them. On merits, the wife of the deceased who is an eye witness has named the petitioner along with others to have dragged the victim away before he was murdered. The petitioner is in custody for less than a year. Offence, if proved, shall attract mandatory imprisonment. Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is disposed of.
