Learned lawyer for the State opposes the prayer for bail We have considered the materials on record including the statement of eye witness who speak of the oral dying declaration made by the deceased implicating the petitioner. In view of the aforesaid materials on record and the gravity of the offence we are of the opinion this is not a fit case to grant bail to the petitioner.
