The appeal was admitted without any scope of consideration of sustenance of the present petitioner and as such, anxiety has been expressed by Mr. Bhattacherjee, learned advocate appearing for the petitioner. As the criminal appeal is pending and there is interim order of stay without hearing the other side, it is very difficult to alter or impose a new condition. Records reflect that the date for Criminal Appeal No. 90 of 2023 has been fixed on 09.08.2023 before the learned Additional Sessions Judge, 6th Court, Alipore. On 09.08.2023, if it is not possible for the learned Additional Sessions Judge, 6th Court, Alipore to complete the appeal, then by 31.08.2023, the learned appellate court will dispose of the Criminal Appeal No. 90 of 2023. No unnecessary adjournment should be granted to either of the parties and in view of the subject-matter involved, the learned appellate court will stick to the date fixed by this Court.

With the aforesaid observations, the revisional application being CRR 2772 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
