Learned counsel for the parties submit that the matter has been settled out of Court between the parties in terms of the memorandum of settlement annexed to the present application, bearing CAN 5 of 2026.

Accordingly, on the basis of the submission of learned counsel for the parties, FAT No. 281 of 2023 is disposed of in terms of the settlement as enumerated in the memorandum of the settlement annexed to CAN 5 of 2026. 3.

The parties shall act in terms of the memorandum of settlement dated March 13, 2026, which is treated to be a part of the decree passed in this appeal.

Consequentially, CAN 1 of 2023 stands disposed of as well.

There will be no order as to costs.

A formal decree be drawn up accordingly.
