This writ petition has been filed by the petitioner being aggrieved by the inaction on the part of the respondents concerned of WBGST in disposing their representation dated 23rd December, 2019 as appears at page 26 being Annexure P-2 to the writ petition making prayer for revising the return relating to the financial year in question with elaborate reasonings which would appear from the said representation.

I am of the view that instead of deciding the issue by this Court, the respondent no.2 should consider and dispose of the representation of the petitioner for redressal of his grievance and for this purpose, and accordingly petitioner is granted to file a fresh representation before the respondent concerned along with the earlier

representation dated 23rd December, 2019 within a week from date and if such representation is made, the respondent no.2 shall consider and dispose of the said representation in accordance with law by passing a reasoned and speaking order after giving an opportunity of hearing to the petitioner or its authorised representatives within four weeks from the date of receipt of such representation and shall communicate his decision to the petitioner within a week.

With this observation and direction, the writ petition being WPA No.19011 of 2021 is disposed of.
