The petitioner is aggrieved that the private respondent no.8 who is an employee of the CESC, has obtained sums of money promising employment. No employment has been given.

Learned counsel for the State submits that an FIR being Bagnan Police Station Case No. 435 of 2020 dated August 23, 2020 has been registered. It is ordered that the investigation into the FIR be taken up and completed as expeditiously as possible, preferably within a period of two months from date. All necessary steps for the purpose of procuring the money misappropriated by the private respondent may be taken by the police.

This Court is of the view that the writ petition, may not be maintainable against the CESC in the facts of the case.

However, the CESC may take steps in accordance with law against the private respondent no.8.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
