The petitioner was a candidate of Post-Graduate course in Law at Amity University, Kolkata. In the 1st semester, her Semester Grade Point Average (SGPA) was 5.23. In the 2nd semester, she got grade point average of 6.27. Therefore, her Cumulative Grade Point Average (CGPA) of the said two semesters was 5.71. As per the relevant Regulations, a candidate should secure an average grade point of 6 to be declared as a successful candidate.

The petitioner's average grade point was less than 6 and as such, she was declared unsuccessful by the University.

Mr. Chakraborty, learned advocate appearing for the petitioner though, strenuously submitted that the cumulative grade point average of 5.71 should be rounded up as 6 as per the existing U.G.C. guideline, no such guideline could be produced by him.

In that view of the matter, I do not see only merit in the application. The petitioner was rightly declared unsuccessful by the University.

The University, however, has submitted that the petitioner will be at liberty to take back the security deposit of Rs.20,000/-, if she so desires.

Accordingly, W.P.A. 18305 of 2022 is disposed of with the liberty upon the petitioner to approach the University for refund of the security deposit amount.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all the formalities.
