Learned Advocate appearing for the petitioner submits that police filed charge-sheet and therefore, custodial interrogation of the petitioner is not required. The petitioner was falsely implicated.

Learned Advocate appearing for the State draws the attention of the Court to the contents of the case diary. He submits that one person died and others received grievous injuries. He further draws the attention of the Court to the statement recorded under Section 161 of the Code of Criminal Procedure as also under Section 164 thereof.

Considering the materials in the case diary and the gravity of the offences and the complicity of the petitioner therein and the statements recorded under Sections 161 and 164 of the Code of Criminal Procedure, we are unable to grant anticipatory bail to the petitioner.

The application for anticipatory bail being C.R.M. 7858 of 2021 is, thus, rejected.
