Mr. Arunava Ganguly ..for the petitioner Mr. Maidul Islam Kayal Mr. Sumit Naskar Mr. N.Amin Sardar Mr. Archishman Singh ...for the private respondent Mr. Debjit Mukherjee Ms. Priyanka Jana ..for the State The petitioner alleges that despite an order of injunction granted by the learned trial Court upon both the parties in respect of the plot in question, the private respondents have been raising construction in the plot in violation of the said order.

Learned counsel for the private respondents submits that the said construction is being raised under the Pradhan Mantri Awaas Yojana-Gramin Scheme-2023. Be that as it may, since a civil dispute is pending between the parties and the learned trial Court has granted an order of injunction in respect of the plot in question, the remedy of the petitioner lies before the learned trial Court.

The writ petition is not maintainable and is accordingly dismissed.

There shall, however, be no order as to costs.
