IN THE HIGH COURT AT CALCUTTA

Criminal Revisional Jurisdiction C.R.R 2958 of 2022 with CRAN 4 of 2023 In the matter of : Sri Ranjan Kumar Ghosh and ors.

...Petitioners.

Mr. Rajdeep Majumder Mr. Abhijit Singh Ms. Sayanti Poddar ...for the petitioners. Affidavit of service so filed be kept with the record. The revisional application has been filed challenging the proceedings of M. P. Case No. 129 of 2022 wherein the learned Executive Magistrate, Bidhannagar was pleased to drop a proceeding under Section 144(2) of the Code of Criminal Procedure. The dispute was between two individuals. As is reflected in the application under Section 144 Cr.PC which was preferred the dispute is private and personal in nature without any element of public law and order being disrupted.

Having regard to the same and the period of time which has lapsed in the meantime, I am of the opinion that further continuance of the said proceedings is unwarranted in the facts and circumstances of the present case. Accordingly, M. P. Case No. 129 of 2022 is quashed.

Consequently, the revisional application being CRR 2958 of 2022 is allowed.

Pending any other application are hereby disposed of. All concerned parties are to act in terms of a copy of this order

duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
