The learned advocate appearing for the petitioner prays for expeditious disposal of complaint case being C/1474/2018 pending before the learned Judicial Magistrate, 5th Court, Alipore under Section 138 of the Negotiable Instruments Act. Learned advocate submits that the present case was initiated almost five years ago and till date, examination-in-chief of the PW-1 has not been completed. Having regard to the spirit of the legislation and the purpose for which the provisions of Section 138 were incorporated in the Negotiable Instruments Act, 1881, I direct the learned Judicial Magistrate, 5th Court, Alipore to henceforth fix at least one date in every 45 days so that trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties and efforts be taken so that trial of the case can be concluded at the earliest. With the aforesaid observations, the revisional application being CRR 2959 of 2022 is disposed of. Pending connected application, if any, is consequently disposed of.
