22.12.2021 sb CRM 7861 of 2021 (Via video conference) In Re: An application for Bail under Section 439 of the Code of Criminal Procedure filed in connection with Swarupnagar Police Station Case No. 932 of 2021 dated 2.11.2021 under Section 14 of the Foreigners Act.

And In the matter of : Subrata Gain .......Petitioner Mr. Kallol Kumar Basu Md. Jannat Ul Firdous Ms. Tithi Majumder ....for the Petitioner Mr. Prasun Kr. Dutta Mr. S. Roy ...for the State Report submitted by the Officer-in-charge, Swarupnagar Police Station, be kept with the record.

The report has been prepared on the basis of communications received from different departments of the Government of West Bengal including BDO Bhatar, F &S Bhatar and BLRO Bhatar, Purba Bardhaman.

As the documents have been found to be genuine as reported by the concerned Officer-in-charge, Swarupnagar Police Station, prima facie, I am of the view that no further detention of the petitioner is required at this stage.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Subrata Gain shall furnish a bond of Rs. 10,000/- (Rupees ten thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Basirhat.

If on bail, the petitioner shall not leave the jurisdiction of Swarupnagar Police Station and shall meet with the Officer-incharge, Swarupnagar Police Station once in a week until further orders. The petitioner will be permitted to leave the jurisdiction of Swarupnagar Police Station only for the purposes of attending the Court.

Accordingly, CRM 7861 of 2021 is allowed.

All parties shall act on the server copy of this order duly obtained from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
