The petitioner is aggrieved by a communication dated 1st August, 2022 by which the petitioner has been directed to vacate the room taken by the petitioner within a month from the receipt of the notice. The reason given in the impugned communication is that the Public Private Partnership Lab facility is no longer required at Maheshganj RH, Nabadwip Block, Nadia. It appears from the records that the petitioner made a representation to the authorities on the very next day i.e. 2nd August 2022.

Learned counsel appearing for the respondents submits that the contract between the petitioner and the respondents expired on 8th April, 2022 and there is no existing contract at present.

However, for the sake of equity, the petitioner should be given more time to vacate the premises, in the event, it is found that the petitioner cannot rely on

subsisting contract. The respondents are also directed to consider the representation of the petitioner within three weeks from today and dispose of the same by way of a reasoned order which shall be communicated to the petitioner within four weeks from the date of passing such order.

W.P.A.18311 of 2022 is disposed of with a direction on the respondents to pass a reasoned order on the representation of the petitioner within the time as directed above. The petitioner shall not be disturbed from their occupation of the premises until four weeks after the reasoned order is communicated to the petitioners.
