Learned counsel for the petitioner contends that despite the private respondents having given a 'no objection' to the petitioner taking a new electric connection at the residence of the petitioner, the West Bengal State Electricity Distribution Company Limited (in short 'WBSEDCL') has not given such connection as yet. Supplementary affidavit-of-service filed today in Court, which indicates that proper service has been effected on the private respondents, be kept on record. Learned counsel appearing for the WBSEDCL hands over a photocopy of the written objection given by the respondent no. 7, which is also kept on record. It is contended by the WBSEDCL that, in view of such specific written objection, the WBSEDCL is unable to give such connection prior to resolution of the objection. Since, as per the extant Regulations, the Concerned District Magistrate is the authority to be

approached for deciding on such an objection, WPA 19026 of 2021 is disposed of by directing the WBSEDCL to refer the matter to the concerned District Magistrate with regard to the objection raised against the petitioner's application for new electric connection within a week from date.

If so approached, the District Magistrate shall decide on such dispute as expeditiously as possible, preferably within an outer limit of four weeks from the date of reference to be made by the WBSEDCL.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
