Ms. Rudra, learned advocate appearing for the petitioner submits that the petitioner had already suffered incarceration for about 366 days and there is no possibility towards early conclusion of the trial and in view thereof, the petitioner may be enlarged on bail on any stringent condition.

Mr. Purkait, learned advocate appearing for the State opposes the petitioner's prayer and draws our attention to several documents in the case diary including the seizure list.

Heard the learned advocates and considered the materials in the case diary.

Prima facie, it appears that there are strong incriminating materials against the petitioner. Contraband substance above commercial quantity was recovered from his possession and in view thereof, the rigours of Section 37 of the NDPS are attracted. As such, the petitioner's prayer for bail is refused at this stage. However, the learned court below is requested to conclude the trial as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

The application for bail being CRM No.7872 of 2021 is, accordingly, disposed of.
