1. The petitioner alleges that the private respondent is illegally extracting ground water for commercial purpose, namely, to sell the same as packaged drinking water.

2. The learned advocate appearing for the State submitted that the Member Secretary, DLA, Howrah has issued stop functioning notice on 22.05.2024.

3. It is not clear as to whether the private respondent has complied with the said notice nor the same has been challenged.

4. In any event if the notice has not been questioned in the manner known to law, the authorities are directed to proceed in accordance with law after issuance parties to the private respondent.

5. Accordingly, the writ petition stands disposed of.

6. Affidavit of service filed by the petitioner is taken on record.
