Galib, Mrs. Amrita Panja Moulick ...for the State The petitioner is aggrieved that despite complaint to the Moyna Police Station, Purba Medinipur, as regards the non-payment of rent and intimidation by the private respondents, no steps have been taken. The private respondents are occupying a portion of the petitioner's property and are no paying rent. The petitioner has demanded such claim.

In so far as the allegations of threat intimidation, counsel for the State submits that proceedings under Section 107 of the Cr. P.C. have been drawn up.

This Court is of the view that the dispute between the private respondents and the petitioner is purely civil in nature and appropriate civil proceedings may be taken out.

The Moyna Police Station, Purba Medinipur shall, however, ensure that there is absolutely no breach of peace in the area.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
