1. The instant matter has been listed at the instance of the petitioner on the ground that a settlement has arrived at by and between the petitioner and the opposite party.
2. In course of hearing learned advocate for the petitioner has filed an affidavit sworn by the petitioner stating interalia that the dispute between the petitioner and the opposite party has already been settled out of court since she has deposited the cheque amount with the opposite party bank.
3. Learned advocate appearing on behalf of the opposite party/Bank raises no objection with regard to the submission as made on behalf of the petitioner.
4. In view of discussion as made hereinabove, and in view of the affidavit as filed on behalf of the petitioner (which has been taken on record) CRR 2493 of 2012 is dismissed for
non-prosecution. Interim order thereto, if any, stands vacated.
5. In view of the disposal of the instant criminal revision the personal appearance of the petitioner is hereby waived and dispensed with.
6. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Partha Sarathi Sen, J.)
