2023-04-12Hon'Ble Justice Siddhartha Roy Chowdhury1 pages

12.04.2023 Serial no.18 Aloke Ct. No. 236 CRR 2966 of 2011 In the matter of : Susmita Roy ... ... petitioner Despite service of notice none is appearing on behalf of the parties.

This revisional application is pending for more than 11 years.

This application challenges the proceedings being C/1266 of 2005 pending before the learned Additional Chief Judicial Magistreate, Alipore under Section 51(1) of the Wild Life (Protection) Amendment Act, 2002 read with Schedule II of the said Act. This revisional application was admitted on 25th of January, 2012 but no interim order was passed. From the report of the learned Additional Chief Judicial Magistrate, Alipore, South 24 Parganas vide memo no. 10337 Cr. Dated 07.12.2022, I find that 21st February, 2023 was fixed for cross-examination of defence witness. Therefore, there is every reason to hold that witness action has almost come to an end. Under such circumstances, I do not find any reason to exercise the inherent jurisdiction to quash the proceeding. The revisional application stands dismissed, however, without costs.

Copy of this order be sent to the learned Chief Judicial Magistrate, South 24 Parganas for information and necessary action.
