Party/Parties is/are represented in the order of their name/names as printed above in the cause title. This is an appeal against the order passed by the Hon'ble Single Bench in WPA No.10691 of 2021 dated 15.11.2021.

By disposing of the writ petition the Hon'ble Single Bench has passed the following order:

"The writ petition is, therefor, disposed of by directing the respondent/Bank to consider the representation made by the petitioner within a period of eight (8) weeks from date, after affording the petitioner a reasonable opportunity to represent his case following Covid protocol. The petitioner's case for transfer should be disposed of by a reasoned order and the same shall be communicated to the petitioner at the earliest.

The authority concerned shall be free to decide the petitioner's case without being any way influenced by the instant order since I have not gone into the merits of the same.

Since I have not called for any affidavit, allegations made in the writ petition are deemed to have not been admitted".

After the order passed by the Hon'ble Single Bench, the Bank had passed an order on 30th of November, 2021 transferring the appellant to Patharghata Chapna Branch with the direction to report for duty on 2.12.2021. As the Bank has passed an order of transfer, nothing subsists in the instant appeal.

However, in the event the appellant has any further grievances, the appellant can make a comprehensive representation of his grievances before the respondent no.2 and, if any representation is made by the appellant, the respondent no.2 shall dispose of the writ petition within a period of eight weeks from the date of receipt of such representation after giving a reasonable opportunity to the appellant to present his grievances.

MAT 1277 of 2021 along with CAN 1 of 2021 stand accordingly disposed of.

The appellant is directed to file a certified copy of the impugned judgment within a period of one week from this date.

In the event the certified copy is not filed, this order shall cease to be operative with immediate effect. All parties to act on a server copy of this order duly

obtained from the official website of the Hon'ble High Court, Calcutta.

Urgent xerox certified copy of this order, if applied for be supplied to the parties, subject to compliance with all requisite formalities.
