Learned advocate appearing for the petitioner is aggrieved by the fact that in spite of Khardah PS Case No. 89/24 dated 08.02.2024 being registered for investigation but no steps were taken by the police authorities and as such petitioner is not aware regarding the status of the investigation of the case. Being aggrieved, he has approached this Court.

Learned advocate for the State has submitted a report.

Report reflects that in connection with Khardah PS Case No. 89/24 dated 08.02.2024, the Investigating Agency on conclusion of investigation submitted charge sheet being

Khardah PS Charge Sheet No. 388/24 dated 25.04.2024.

Having considered that the charge sheet has been submitted and the defacto complainant do not have any knowledge, I grant liberty to the learned Court in seisin of the issue that in case an application under section 173(8) of the Cr.P.C. is filed, learned Magistrate would assess and ascertain the genuinity of the accusations as also the requirements so far as the investigation is concerned and pass necessary directions as he deems fit and proper.

Learned advocate for the respondent nos. 6 & 7 submits that the incident complained of was at a belated stage and the factual foundations which have been laid down in the case is embellished for implicating the private respondents.

Learned advocate vehemently denies the accusations which have surfaced so far as the private respondents are concerned.

Be that as it may, in view of the directions passed above, petitioner would be at liberty to take steps.

With the aforesaid observations WPA 17923 of 2025 is disposed of.

Report submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.
