Learned Counsel for the petitioner and the Kolkata Municipal Corporation (KMC) are present. 2.

With the consent of the parties, the matter is finally heard.

During the course of hearing, learned Counsel for the parties reached to a consensus that this petition filed in the nature of a Public Interest Litigation (PIL) may be disposed of by directing KMC to initiate proceedings under Section 400 of the Kolkata Municipal Corporation Act, 1980 (hereinafter referred to as the 'KMC Act') against the alleged illegal construction pointed out in this petition and conclude the proceedings in accordance with law expeditiously.

It is also agreed that the said proceedings be initiated and concluded in accordance with law without getting influenced by paragraphs 4 and 5 of the report filed in this case on August 23, 2025.

In view of consensus arrived at between the parties, PIL is disposed of by directing KMC to initiate proceedings under Section 400 of KMC Act against the illegal construction impugned herein and complete the proceedings in accordance with law expeditiously preferably within six months. 6.

It is made clear that this Court has not expressed any opinion on the merits of the case. (Sujoy Paul, J.) (Smita Das De, J.)
