1. Nobody appears on behalf of the appellant.
2. State is represented by the learned advocate.
3. In pursuance of the direction passed by this Court earlier on 28.4.2025, a report is submitted by the Superintendent, Balurghat Central Correctional Home indicating that the sole appellant/convict, Netai Karmakar, who was sentenced on 17th March, 2016 by the order passed by the learned Trial Court at Balurghat, Dakshin Dinajpur to suffer R.I. for seven years along with a fine of Rs. 40,000/- and in default of payment to suffer R.I. for six months under Section 04/18 of POCSO Act had been released after completion of his sentence on 12.01.2021 including the set offs and non-payment of his fine amount also.
4. As the sole appellant/convict has already served out the sentence, the instant appeal is liable to be dismissed.
5. The judgment and order dated 16.03.2016 and 17.03.2016 passed by the learned Judge, Special Court-cum-Additional District Judge, 2nd Court, Balurghat, Dakshin Dinajpur in connection with Special Trial No. 01(07)/2014 and Special Case No. 02/2014 is hereby affirmed.
6. Accordingly, the instant appeal be and the same is hereby dismissed on merit.
7. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately.
