The grievance of the petitioner is that, despite having applied for a new electric connection, the distribution company is sitting tight over the matter. Learned counsel for the distribution company contends that although the personnel of the distribution company went several times to the premises-in-question to give such connection, due to resistance of the public at large, such connection could not be given.

Learned counsel for the distribution company further argues that the objectors ought to have been impleaded in the present writ petition.

However, the last submission made on behalf of the distribution company does not hold water, since an indefinite, undisclosed group of people cannot be impleaded in the writ petition by the petitioner, without

knowing the whereabouts or particulars of such objectors.

That apart, in the event the petitioner is otherwise entitled in law to a get new connection, there is no reason why such connection shall not be given by the distribution company, subject to compliance of all formalities, at the earliest.

Accordingly, WPA 19069 of 2021 is allowed, thereby directing the respondent no.3 to give the new electric connection as per the petitioner's application, upon compliance of all formalities, within December 17, 2021. In the event the personnel of the distribution company face any resistance from any quarter while giving such connection, it will be open to the said personnel to approach the respondent no.4, the Inspector-in-Charge, Joynagar Police Station for adequate police help.

If so approached, the respondent no.4 shall immediately arrange for such police help at the cost of the petitioner.

The parties shall act on the written communication of the learned advocates accompanied by server copies of this order without insisting upon prior production of a certified copy.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
