Mr. Barnamoy Basak ...for the petitioner No one represents the Union of India today. A prayer for accommodation is made.

On the last occasion also an accommodation has been sought for on behalf of learned counsel appearing on behalf of the Union of India. The prayer for accommodation was allowed on October 9, 2023 when no one represented the Union of India.

By an order dated July 25, 2023 the Deputy Inspector General (DIG), Signal Range, CRPF moderated the order of penalty dated April 27, 2019 from "Removal from Service" to an order of 'compulsory retirement' with effect from April 27, 2019 with full pensionary benefits and gratuity under the provisions of Rule 40 of the CCS (Pension) Rules, 1972.

The period of unauthorised leave with effect from March 13, 2018 to April 26, 2019 is treated as 'Dies NON' and was condoned for the purpose of

pension under Rule 27 of the CCS (Pension) Rules, 1972.

Mr. Basak, learned counsel appearing on behalf of the petitioner submits that nothing further remains to be adjudicated in the matter.

Accordingly, WPA 18421 of 2022 is disposed of with a request to the authorities concerned to consider disbursal of the pensionary benefits to the petitioner within 2(two) months from the date of this order.
