"The State shall file a report disclosing as to why, despite the letter dated December 29, 2024, the taxing officer imposed a penalty of Rs. 73,938/- by the letter dated July 16, 2025.

Let such report be filed within two weeks from date."

Fortunately, Mr. Pantu Deb Roy, learned advocate appearing for the State, on instruction, submits that no penalty will be imposed against the petitioner. Let the instruction filed By Mr. Deb Roy be kept with the records.

In view of the aforesaid stand of the State, nothing further remains to be decided in this writ petition. Accordingly, WPA 17879 of 2025 stands disposed of. Urgent certified website copies of this order, if applied

for, be made available to the parties upon compliance with the requisite formalities.
