Anoop Kumar Gupta Mr. Subha Pathak ..for the petitioner The present proceedings relate to the provisions of Protection of Women Domestic Violence Act, 2005. Records reflect that last date was fixed on June 2021 for cross-examination of PW 1.

Having regard to the fact that the case was instituted in the year 2013, I am of the view, that some directions should be passed for expediting progress of the trial. Keeping in mind that the courts were operating in a staggered manner for a considerable period of time in the year 2020 and in the year 2021, it is difficult to specify a time limit. However, the Learned Magistrate is directed to consider the plight of the present petitioner and fix schedule in such a manner that the case should be taken to its logical conclusion within a reasonable period of time. Needless to state that the court should also appreciate that the provision was incorporated for providing remedies which would take into account not only the maintenance but also other remedies which were not incorporated earlier under the Civil Law.

The petitioner will be at liberty to approach this court afresh if no substantial progress is achieved by July 2022. With the aforesaid observations CRR 2398 of 2021 is disposed of.
