Sl.17 07.08.2025 Court No.6 BP C.O. 2832 of 2025 Akhil Bharat Jaiguru Sampradaya (A.B.J.S.) -versusSree Satyadharma Prachar Sangha (Joyguru Sampradaya) Mr. Abhee Dutta ... for the petitioner This application under Article of the Constitution of India is at the instance of Akhil Bharat Jaiguru Sampradaya, a Trust represented by General Secretary Sri Priyanath Chattopadhyay challenging an order dated 9th June, 2025 passed by the learned Civil Judge (Junior Division), Bidhannagar, North 24 Parganas in Title Suit No. 41 of 2021.

By the impugned order the learned trial judge held that the appointment of Sri Mahargha Mukherjee has not been in any way terminated and the court does not find any impediment in proceeding with the suit represented by the defendant through Mahargha Mukherjee and the suit was directed to be proceeded by the defendant represented by Mahargha Mukherjee and 23rd June, 2025 was fixed for hearing of the maintainability application.

The learned advocate appearing for the petitioner submits that the maintainability application has been filed by Priyanath Chattopadhyay. He submits that the

appointment of Mahargha Mukherjee has been terminated.

However, since the learned trial judge has fixed a date for maintainability petitioner filed by Priyanath Chattopadhyay as submitted by the learned advocate for the petitioner C.O. 2832 of 2025 stands disposed of by requesting the learned Civil Judge (Junior Division), Bidhannagar, North 24 Parganas to dispose of the maintainability application as expeditiously as possible after giving an opportunity of hearing to the respective parties.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
