By this writ petition, petitioner has made prayer for relief by way of direction upon the respondent PWD authority concerned for considering his claim for reimbursement of the differential amount of tax due to change in the rate of tax with effect from 18th July, 2022 along with payment of statutory interest. During the pendency of this writ petition it has been brought to the notice of this court, by the parties, that during the pendency of this writ petition the respondent authority concerned

has asked the petitioner for producing relevant documents for consideration of the petitioner's aforesaid claim, by mail, by memo dated 21st July, 2023. Petitioner has already given replies dated 11th August, 2023 against the aforesaid memo dated 21st July, 2023.

Considering the facts and circumstances of this case and submission of the parties this writ petition being WPA 18023 of 2023 is disposed of by directing the respondent No. 2 to consider the aforesaid replies of the petitioner in accordance with law and to take a final decision on the aforesaid claim of the petitioner after giving opportunity of hearing to the petitioner or its authorized representatives within a period of four weeks from the date of communication of this order.
