CESC Limited and another Mr. Indranil Halder ... for the petitioner Mr. Debanjan Mukerjee ... for the CESC The petitioner applied for new connection. The petitioner claims to be a tenant in respect of the shop room. The CESC authorities are willing to supply electricity by way of a loop meter connection from the existing meter board place.

The writ petition is disposed of directing the CESC authorities to supply new connection to the petitioner in accordance with law, provided the petitioner is found to be in possession of the shop room and can submit documents in support of his status either as an occupier or as a tenant in respect of the property in question. The CESC can also seek police protection.

It is made clear that no person who is found to be in occupation in any premises, can be denied electricity. However, such grant of electricity shall not create any equity in favour of the petitioner and the same will be subject to any civil litigation that

may be initiated against the petitioner in respect of the property in question.

All parties are to act on the basis of the server copy of this order.
