CESC Limited and another Mr. Indranil Halder .... for the petitioner Mr. Debanjan Mukherji .... for the CESC Limited Learned counsel for the petitioner contends that the petitioner sought for a new electricity connection which was refused, primarily on the ground that there is an existing service connection, which is being enjoyed by the petitioner in the same premises. However, learned counsel for the petitioner submits that the service connection, which is existing, is in respect of premises different from where the connection is now sought. Such contention, however, is disputed by the CESC Limited.
Since a factual dispute has arisen on such score, an adjudication by the writ court would prematurely deprive the parties of a forum.
Since, under the governing Regulations, the Grievance Redressal Officer (GRO) is the appropriate authority to decide such disputes, WPA No. 18025 of
2023 is disposed of by granting liberty to the petitioner to approach the concerned GRO for resolution of the issues. If so approached, the GRO shall decide the issues between the parties in accordance with law, as expeditiously as possible and on giving opportunity of hearing to all concerned, preferably within six weeks from the date of such approach.
There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
