Mr. Amanul Islam Mr. Sourav Mukherjee ...for the petitioners Mr. Pravas Bhattacharya Mr. Parvej Anam ..for the State Learned counsel appearing on behalf of the petitioners submits as follows. There was a free fight between co-villagers over a property. Both sides suffered injuries. The petitioners have been falsely implicated in this case.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the statements of witnesses including the injured ones. He also relies on the injury report, especially one which shows a fracture injury on the patella. Considering the above and the other incriminating materials available in the case diary, while I am inclined to grant anticipatory bail to the female members of the family namely Sk. Supiya Begum (petitioner no.1), Ms. Moslima Begam (petitioner no.4) and Ms. Rupsona Begam (petitioner no.7), the application for anticipatory bail of the other co-accused being the petitioner nos. 2, 3, 5, 6 and 8 is rejected.

Accordingly, the application for anticipatory bail of the petitioner nos. 1, 4 and 7 is allowed.

In the event of arrest, the petitioner nos. 1, 4 and 7 shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner nos. 1, 4 and 7 shall not threaten or intimidate witnesses and shall co-operate with investigation.

The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
