1. The present revisional application has been preferred challenging the legality of an order dated 2nd May 2025 passed in NDPS Case No. 70 of 2021 pending before the Court of learned Additional District Judge, 4th Court, Malda.

2. Mr. Majumder, learned Advocate appearing on behalf of the petitioner submits that due to communication gap in between the petitioner and the learned Advocate, who represented him before the learned Court below, the petitioner was not aware on that day and, hence, could not appear in the Court on that date and, accordingly, warrant of arrest was issued. He further submits that the procedures needs to be followed before warrant of arrest has not been followed in this case. The petitioner undertakes to attend the Court and pray for regular bail.

3. Having heard the learned Advocate for the petitioner and upon perusal of the materials on record, I find merits on the contention of the petitioner. Accordingly, the warrant of arrest against the petitioner in connection with NDPS Case No. 70 of 2021 be stayed until the end of November 2025 or until further order, whichever is earlier.

4. If the petitioner appears before the Court within first week of November 2025, he shall be allowed to remain on the same bail.

5. With these observations and the order, the revisional application is allowed.
