This is an application for expeditious disposal of Case No. SC-92 of 2021 arising out of Titagarh Police Station Case No.82 of 2020 dated 4th February, 2020 under Section 306 of the IPC corresponding to G.R. no. 970 presently pending before the learned 3rd Fast Track Court, Barrackpore.

On perusal of averment made in the instant revision and having heard the learned Advocate for the petitioner this Court of the view that the instant revision can be disposed of here and now with the assistance of the learned Advocate for the state. Accordingly, Mr. Pratick Bose, learned Advocate is requested to assist this Court on behalf of the state. Appointment of Mr. Pratick Bose, learned Advocate be regularized by the learned Legal Remembrancer, Government of West Bengal.

It is submitted by the learned advocate for the petitioner that the opposite party registered the present case on 4th February, 2020 against the petitioner stating that one Sunita Banerjee (Adhikary) who was married to the deceased son of the complainant, late Tanmoy Banerjee, she along with Sukumar Adhikary, Sabita Adhikary and Santanu Adhikary inflicted physical and mental torture on the deceased since marriage and pressurized him to extract money. Unable to bear such pressure and torture the deceased son of the complainant committed suicide on 15th January, 2020. Charge-sheet was duly submitted on 30th September, 2020, the cognizance was taken on 15th December, 2021 by the Additional Sessions Judge, Barrackpore. The Court below received the case record on 18th January, 2022 and several dates were fixed but till date public prosecutor has not been appointed and charge not framed. Next date is fixed on 25th August, 2022.

Under such circumstances, petitioner has prayed for expeditious disposal of the case.

Having heard the learned Advocate for the petitioner it is found that till date charge has not been framed by the trial court. Therefore, question of any direction for expeditious disposal of the abovementioned case does not arise at this stage. However the Learned Court below is directed to Charge frame as early as possible.

The instant revision is accordingly dismissed. (Bibek Chaudhuri, J.)
