Petitioner is represented by her law lawyer, who files affidavit-of service along with two undelivered envelopes address to the opposite party, one envelope bearing address at B6/62 Kalyani, with postal endorsement addressed moved out.

The other envelope addressed at B-5/1 (CA) Kalyani, the address appearing in the cause title of Mat suit filed by the husband opposite party shows addressee absent but intimated over mobile phone, but refused to accept and returned unclaimed.

Be that as it may, the petitioner wife has filed the present application under Section 24 of the CPC praying for transfer of Mat Suit No. 261 of 2019 from the Court of learned Additional District Judge, Fast Track, Kalyani to learned Additional District Judge, Sealdah.

It has been stated that wife is at present residing at Rajabazar, under Amhert Street Police Station at her paternal house. The wife has no source

of income of her own. Therefore, it would not be possible of her part both physically or financially to attend the Court at Kalyani.

Since Kalyani and Sealdah is well connected by multiple local trains and distance is not so far away as contended.

Therefore, this Court does not find any merit in the application and the same is rejected.

Accordingly, C.O. 2056 of 2021 is disposed of.

Connected application, if any, also stands disposed of.

Interim order, if any, stands vacated.

There shall be no order as to costs.

Parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, be applied for, be given to the parties, upon compliance of all formalities.
